
North Dakota’s Senate has given the state government authority over local power line rules. The Senate passed House Bill 1258 with a 27-18-2 vote on April 4, giving the Public Service Commission power to override local government rules that conflict with state-approved electric transmission projects. The bill previously passed the House 86-7-1. The legislation mirrors existing pipeline siting language currently being challenged in court by counties affected by the Summit Carbon Solutions pipeline. While no opposition emerged during House hearings, the Senate committee hearing drew overflow crowds and resulted in a 4-3 recommendation against passage. The $440 million JETx transmission line between Jamestown and Ellendale remains central to debate. Supporters argue such infrastructure is vital for energy industry growth, while opponents maintain local zoning protects community development plans and neighbors’ interests. The bill now heads to the governor for consideration.
