Drug Company AbbVie Sues North Dakota Over Pricing Law

A drug manufacturer is suing North Dakota over the recently-passed law requiring lower prices.   The suit takes aim at House Bill 1473 which requires drug companies participating in a federal funding program to offer a larger percentage of their medications at a discount.

The company AbbVie says that law is in violation of federal statues including the Supremacy Clause.   AbbVie also claims in their court filings that North Dakota is making an illegal attempt to regulate interstate business.

They are asking a federal court to declare the law unconstitutional.

The case could eventually be heard by the Eighth Circuit Court of Appeals which encompasses states in the Midwest.
