AGCO Throws Wrench in “Right to Repair” Case

AGCO has asked a federal court to allow an unusual appeal in the ongoing right-to-repair case brought by the Federal Trade Commission against John Deere.

The company seeks to prevent Deere from gaining access to sensitive financial and business data that AGCO, CNH Industrial, and Kubota were required to provide to the FTC during its investigation. AGCO argues that releasing this critical information cannot be undone once disclosed and that no court has yet clarified the rules governing such disclosures.

While the court has placed confidentiality protections on the release of competitor data, AGCO insists app  review is necessary to safeguard its proprietary information and ensure a consistent legal standard moving forward.
