A federal judge has rejected an attempt by AGCO to file a rare early appeal in the ongoing right-to-repair lawsuit against John Deere.
AGCO and other equipment makers objected to a ruling that gives Deere access to highly sensitive competitor data — including pricing, sales, and dealer profitability — collected by the FTC during its investigation.
AGCO argued that the court failed to apply the heightened protections usually given to confidential business information, but officials said the chances of AGCO winning on appeal were low and that strict confidentiality safeguards were already in place.
If successful, the lawsuits could expand right-to-repair access for farmers, while also setting a major precedent for how courts handle sensitive competitor data in antitrust cases.
