North Dakota is not joining a multistate lawsuit over a possible halt to federal food-benefit payments.
Leaders in 26 states and the District of Columbia filed suit Tuesday against the U.S. Department of Agriculture and the Trump administration. The lawsuit argues the government acted unlawfully by halting Supplemental Nutrition Assistance Program payments for November and refusing to use emergency reserve funds.
The case was filed in federal court in Boston. States leading the challenge include California, New York, and Michigan. North Dakota and other Upper Midwest states did not join the lawsuit. Governor Kelly Armstrong has not publicly commented on the issue.
Current funding for SNAP benefits is set to expire Friday unless federal action, or a stopgap by the states extends the food assistance program.
