North Dakota and EPA Come to Agreement on Coal Ash Disposal

North Dakota has launched its own coal ash recycling and disposal program following an agreement between Governor Kelly Armstrong and the EPA. The move stems from a 2016 law authored by Senator John Hoeven, which gave states the authority to manage coal ash under federal oversight.

The program aims to reduce confusion and costs that followed a 2014 EPA rule, while also improving recycling efficiency and providing greater regulatory stability for coal producers.

The new system will ensure safe recycling practices, promote the use of coal ash in construction materials, and establish strict permit and monitoring standards for disposal sites. Senator Hoeven said the program provides “a more stable footing” for producers while benefiting both the environment and economy.
