Pharmaceutical companies have sued North Dakota over a law covering access to low cost drugs.
The State Legislature passed the new law earlier this hear in House Bill 1473 which forbids companies from limiting access to low-cost drugs in hospitals and pharmacies.
The companies suing allege that the law harms their ability to make profits and violates the federal government’s supremacy clause that regulates pharmaceutical distribution across the country. AbbVie, AstraZenca, and Pharmaceutical Research and Manufacturers of America have signed onto the suit.
State lawyers have dismissed the plaintiff’s claims.
According to the North Dakota Monitor, which reported on the story Tuesday morning, the lawsuit is similar to ones filed in multiple other states by pharmaceutical companies seeking to limit similar laws regulating their industry.
