ND Supreme Court Rules Against Greenpeace

North Dakota’s Supreme Court has ordered a lower-court judge to partially halt Greenpeace International’s lawsuit in Amsterdam against Energy Transfer, the company behind the Dakota Access Pipeline.

The justices said Greenpeace cannot pursue Dutch claims that the North Dakota civil case against Greenpeace was legally baseless, but they said other claims raising separate issues can still move forward.  The court’s opinion also pointed to Dutch filing coming just before the North Dakota trial, which the majority said could undermine Morton County’s verdict against Greenpeace.

Chief Justice Lisa Fair McEvers dissented, saying the lower court acted within its discretion when it refused to block the Netherlands case.

Greenpeace has 14 days to seek rehearing on this ruling.

Separately, Greenpeace has said if it does not win a new trial in the North Dakota pipeline case, it plans to appeal that judgment to the North Dakota Supreme Court.
