A Democratic-NPL candidate has withdrawn from a northeastern North Dakota legislative race after learning her candidacy could conflict with federal law.
Lynnell Popowski withdrew from the District 19 state House race Tuesday. Popowski works for the Minnesota Department of Transportation in a position supported by a federal grant.
She told the North Dakota Monitor that her supervisor advised her the partisan candidacy violated the Hatch Act. The federal law restricts some political activities by state and local government employees whose jobs are connected to federally funded programs.
Popowski ran unopposed in the June primary.
Deputy Secretary of State Sandy McMerty says state law does not give the Democratic-NPL Party a way to replace her on the November ballot.
The House race now includes Republican incumbents Karen Anderson and David Monson and Democratic-NPL challenger Jolene Hermanson. Voters will elect two representatives.
