An attorney for North Dakota’s Public Service Commission said in a hearing Tuesday that the agency has no legal authority to consider public safety when approving pipeline permits. During the appeal hearing over the Summit Carbon Solutions pipeline, commission attorney Zachary Pelham said that the agency can consider public welfare, but safety is strictly a federal issue. Landowners and county attorneys found this argument illogical, according to the North Dakota Monitor. District Judge Jackson Lofgren did not issue a ruling, and is taking the case under advisement.
