State leaders say Burleigh County Sheriff Kelly Leben is eligible to serve on the North Dakota Ethics Commission, despite questions about whether a local elected official can hold the role.
The North Dakota Monitor reports Leben was selected last week to fill a vacancy on the commission.
The question centered on language in the state Constitution that bars public officials from serving on the commission. Ethics Commission Director Rebecca Binstock says the commission interprets that restriction as applying to elected or appointed officials in state executive or legislative offices, not local officials.
Leben is expected to remain sheriff until retiring at the end of the year. His Ethics Commission term runs through August of 2027.
The selection committee is also considering a replacement for another commissioner. Its next meeting is July 7.
