A 58-year-old Jamestown man accused of plotting to murder his estranged brother was sentenced in Southeast District Court on computer crime charges. The Jamestown Sun reports Kelly Spivey pleaded guilty to computer crime and computer fraud misdemeanors after allegedly asking a co-worker to hack into his brother’s home security system. Prosecutors say Spivey wanted to know when his brother was home alone.
More serious charges, including criminal attempt to commit murder and terrorizing, were dismissed as part of the plea agreement. Judge Troy LeFevre sentenced Spivey to eight days already served in the Stutsman County Correctional Center, 18 months supervised probation, and $325 in fees, according to court documents. Spivey claimed he only wanted access to see his father on security cameras, not harm his brother.
