The North Dakota Supreme Court has rejected a challenge to an early approval for the Jamestown-to-Ellendale JETx transmission line.
The justices ruled townships and landowners lacked standing to appeal the Public Service Commission’s 2024 finding that the project served a public need. The challengers sought to join the case after the commission had issued its decision.
The court also upheld the commission’s denial of that late request. Justices found the PSC provided sufficient notice through 14 newspapers, including the official newspaper in each affected county.
The ruling focused on participation and timing rather than the challengers’ argument over which state law governed the approval.
JETx would carry electricity along a 92-mile route through Stutsman, LaMoure and Dickey counties. The Public Service Commission approved the project’s final route permit in June.
